Luma Albums Português

Terms and conditions

Last updated: 24 October 2026

1. Who we are

Luma Albums and Luma Studio belong to Nelson Silva, sole trader trading as VisualMind, Portuguese tax number (NIF) 257272259, business address Rua de São Vicente, 20, Braga, Portugal ("VisualMind", "we"). Contact: [email protected]. These terms apply to anyone who downloads, buys or uses Luma Albums, and to anyone who subscribes to Luma Studio.

2. Purchase and payment

Purchases are made through Polar (Polar Software, Inc.), which sells as merchant of record: it takes the payment, issues the invoice and handles VAT. Prices on the website include VAT. Your licence key arrives by email right after the purchase. Polar's terms apply to the payment; these terms apply to the licence and the service.

3. Refunds and right of withdrawal

You may ask for a refund of any purchase, without giving a reason, within 14 days of buying. Write to [email protected] from your purchase email. We ask Polar to return what you paid by the same payment method, within 14 days, and the key is deactivated. For Luma Studio, the account's proofs follow section 5.5.

This meets the consumer right of withdrawal and goes further: the refund applies even if you have already activated the licence or used the service.

4. The Luma Albums licence

4.1 Evaluation

Without a licence, the app works with no time limit as an evaluation: it exports only JPEG and PDF, watermarked and at a reduced size.

4.2 What the licence gives you

4.3 One Mac per licence

Each licence activates on one Mac. The app confirms the licence online and then works for up to 14 days offline. Activations do not transfer to another Mac. If you repair or reinstall the same Mac, or replace it after a fault, write to us and we will free the activation.

4.4 What you may not do

You may not resell, rent, share or distribute the app or the key, or get around the activation, the watermark or other protections. Decompiling and reverse engineering are allowed only where the law expressly permits them.

4.5 Your work

The albums, photos and everything you create with the app are yours. The app, its code, the bundled layouts and the Luma Albums brand are ours. Opening projects from other applications is a compatibility conversion: always check the result before sending it to print.

5. The Luma Studio subscription

5.1 The service

Luma Studio is an online proofs service: you publish an album from the app and your client reviews, comments on and approves it through a link. It requires a Luma Albums licence and activates on one Mac.

5.2 Price, renewal and cancellation

The subscription is yearly, paid in advance, and renews automatically for the same period at the price then in force. If the price changes, we email you at least 30 days ahead and you can cancel before the renewal. You can cancel at any time in Polar's customer portal (the link is in your purchase email). The subscription ends at the end of the paid period. Outside the refund period, periods already paid are not refunded.

5.3 Limits

Each account has a storage allowance (1 GB by default) and can send up to 50 emails to clients in 24 hours. The limits protect the service and the reputation of its emails. If you need more, talk to us.

5.4 Acceptable use

By publishing a proof, you confirm that you hold the rights to the images and may share them with your client. You may not use Luma Studio for unlawful content, content that infringes others' rights or that exploits minors, for unsolicited or misleading email, or to try to reach other people's proofs. We may suspend an account that breaks these terms. Unless it is urgent, we tell you first and explain why.

5.5 When the subscription ends

When the subscription ends, the proofs stay read-only for 30 days. During that time you can renew, and the app keeps reading comments and approvals. After that, the proofs are deleted from the server, and from the backups within 14 days.

5.6 Your clients' data

In the proofs, you are the controller of your clients' data, and VisualMind processes it only on your behalf. The data processing agreement is part of these terms and applies automatically to every subscription. It is up to you to tell your clients that the proofs are hosted on Luma Studio.

5.7 Availability and backups

We do what is reasonable to keep the service available and we make daily backups, but we do not promise that there will never be interruptions. Luma Studio is not an archive: always keep the originals and your albums on your Mac.

6. Warranty and liability

If you are a consumer, you have the legal guarantee of conformity for digital content and services (in Portugal, Decree-Law 84/2021): if the app or the service is not in conformity, we fix it, and if that is not possible, we reduce the price or refund you. These terms do not limit the rights the law gives you as a consumer.

Beyond those rights, and as far as the law allows, we are not liable for indirect damage such as lost profits, clients or data, and our total liability is limited to what you paid us in the previous 12 months. These limits do not apply to intent, gross negligence, or harm to life or health. Always check final proofs and export files before sending them to print: whoever approves printing is responsible for what is printed.

7. Changes to these terms

We may update these terms. If a change affects your subscription, we email you at least 30 days ahead and you can cancel before it applies. A licence you have already bought keeps the conditions in section 4.

8. Law and disputes

Portuguese law applies. If you are a consumer, you keep the protection of the mandatory rules of the country where you live. For consumer disputes you may turn to CNIACC, the Portuguese National Centre for Consumer Dispute Information and Arbitration (www.cniacc.pt), or another competent alternative dispute resolution body. Businesses in Portugal also offer the electronic complaints book, the Livro de Reclamações Eletrónico.
